Creative Kernow Associates Membership Terms and Conditions

Thank you for joining Creative Kernow Associates (“CKA”). This webpage sets out the terms and conditions of your membership. You should read it carefully as it sets out your rights and obligations as a member of the network (“Membership”).

These terms and conditions of membership should also be read in conjunction with the Privacy Policy and Code of Conduct.

Please note that registeration of your membership with CKA creates a valid and legally binding agreement between you and Creative Kernow, which is governed by these terms and conditions.

Background

(A) CKA is a new membership programme for the creative and culture sectors in Cornwall and the Isles of Scilly. With a principle of building a more sustainable model that’s tailored to the needs of the creative and cultural sectors in Cornwall and the Isles of Scilly in mind, CKA provide its membership with resources, information, opportunities and events.

1. Definitions

1.1 In these terms and conditions, the following words have the following meanings:

  1. Member means you and/or any other member of the network (depending on the context in which it is used). Please note that these terms and conditions apply to all members.
  2. Membership Period means the date from which you registered with CKA.
  3. CKA is Creative Kernow Associates.
  4. Creative Kernow is a charity supporting creativity in Cornwall which CKA is part of.

2. Your details

2.1 During your time as a Member, we will collect information about you to personalise your experience of Membership. We collect information about you in a variety of ways including, but not limited to:

2.1.1 when you join as a Member;

2.1.2 each time you apply for a bursary;

2.1.3 when you make bookings for events;

2.1.5 when you create an online membership profile;

2.1.6 when you respond to BAN’s emails;

2.1.7 where in Cornwall you live; and

2.1.8 which creative discipline do you work in.

2.2 All information that you provide to CKA will be processed and held in accordance with the UK Data Protection Act and the EU General Data Protection Regulation (GDPR) and all other applicable UK and EU law.

2.3 You agree that personal details provided to CKA may be used for administrative purposes to fulfil your membership rights and provide membership services to you. In some cases we work with third parties and external suppliers to provide evaluation and event-related services. Creative Kernow have assured the data safeguarding measures of all organisations with which your personal data is shared.

2.4 As part of your membership, CKA may also send you information about any organisation where we feel these would be of interest to you. We may contact you by email.

2.5 You are responsible for informing us of changes to your personal details. Please do not share your individual passwords for access to our on-line services with anyone else.

2.6 CKA only collects or processes sensitive personal data, such as information about race, etc. etc. for statistical purposes. Such data is always anonymised immediately post collection.

2.7 Subject to clause 2.3 CKA will never sell, rent or exchange your details with any other organisation outside of Creative Kernow.

2.8 You may opt-out of communications from CKA at any time, although forms part of your Membership benefits. You can unsubscribe from CKA emails via the unsubscribe link at the bottom of all emails sent to you by CKA.

2.9 In case you no longer wish to be a member and would like your data to be removed from all databases, please e-mail associates@creativekernow.org.uk .

3. Your Membership

  • As a Member of CKA you are entitled to access 1-2-1 advice sessions, certain resources, events and make applications for opportunities organised by or connected with CKA, as advertised on the CKA website and via email communications.
  • You are also encouraged to share your news with CKA so we can promote them to a wider network.
  • Your membership plans are automatically recurring, but you can cancel at anytime. The fee is not refundable, unless in exceptional circumstances.

4. Publications and other materials

4.1 Unless stated otherwise, copyright and all other rights in all publications and materials supplied to you by CKA are owned by CKA. Members may not reproduce, transmit, distribute, sell or commercially exploit these materials without the prior written consent of CKA or to the extent expressly permitted by law.

5. Liability

5.1 CKA excludes all liability to members or to any other third party for any loss of profit, or any special, incidental or consequential damages (however arising, including negligence) arising out of, or in connection with services, benefits and/or products supplied by CKA or any member of CKA.

5.2 Nothing in these terms and conditions excludes liability for death or personal injury caused by CKA’s negligence or for fraud or fraudulent misrepresentation.

6. Freedom of Information Act 2000 (“FOIA”)

6.1 Creative Kernow is a ‘Public Authority’ for the purposes of FOIA. Subject to certain exemptions, BAN may be required to release information to a third party upon request which may relate to the network.

6.2 CKA shall not be liable for any loss or damage that any member may suffer as a result of CKA’s disclosure of information under FOIA.

6.3 The obligations contained in this clause 6 shall remain in force notwithstanding the termination of this Agreement for any reason whatsoever.
